These Terms and Conditions ("Terms") govern your access to and use of https://outboardrepowershop.com and the purchase of any products, including used outboard motors, refurbished outboard engines, repower kits, and marine accessories (collectively, the "Products"). By accessing the Site, placing an order, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase any Products.

1. Eligibility

2. Product Descriptions and Pricing

We make every effort to display accurate product information, including descriptions, images, specifications, condition reports (especially for used and refurbished motors), and pricing. However, we do not warrant that product descriptions or other content are complete, reliable, current, or error-free.

Prices are listed in U.S. Dollars (USD) and are subject to change without notice. All prices exclude applicable taxes, shipping charges, and any customs duties. We reserve the right to correct any pricing errors and cancel or refuse orders placed at incorrect prices, even after order confirmation.

3. Orders and Payment

• Placing an order constitutes an offer to purchase. We may accept or reject any order at our discretion.
• Payment must be made in full at checkout via accepted methods (credit/debit cards, PayPal, etc.). We use secure, third-party payment processors and do not store full credit card details.
• Title and risk of loss pass to you upon delivery to the carrier (FOB Shipping Point).
• We reserve the right to limit quantities, cancel orders, or refuse service for any reason, including suspected fraud.

4. Shipping and Delivery

All shipping is governed by our separate Shipping Policy. We offer free shipping within the United States and a $150 flat rate for select international orders. Delivery times are estimates only; we are not liable for delays caused by carriers, weather, or other factors beyond our control.

5. Returns, Refunds, and Warranties

Returns, refunds, and warranty claims are governed by our separate Return & Refund Policy. We provide a 30-day money-back guarantee on eligible items and a minimum 90-day satisfaction promise on used and refurbished outboard motors.

Products are sold with any manufacturer warranties (if applicable) and our limited warranty as described in product listings and the Return & Refund Policy. EXCEPT AS EXPRESSLY STATED, ALL PRODUCTS ARE SOLD "AS-IS" WITH NO ADDITIONAL WARRANTIES.

6. Limitation of Liability and Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW:

• THE SITE AND PRODUCTS ARE PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
• WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.
• IN NO EVENT SHALL OUTBOARD REPOWER SHOP, ITS OWNERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
• OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above may not apply to you.

All content on the Site (text, images, logos, product photos, etc.) is owned by us or our licensors and protected by copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works without our written permission.
